Terms of Service

Welcome to Nowt On (trading as "Nowt On"). These Terms of Service ("Terms") govern your access to and use of the Nowt On platform, including our website at nowton.events, related applications, and all associated services (collectively, the "Platform").

The Platform is operated by Freddie Ryan trading as Nowt On, Kendal, Cumbria, England ("Nowt On", "we", "us", or "our").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform. These Terms should be read alongside our Privacy Policy, which explains how we collect and handle your personal data.

1. About the Platform

Nowt On is a local events discovery platform that helps communities find and share events happening in their area. The Platform enables:

  • Browsing and discovering local events on an interactive map
  • Businesses and event organisers to list and manage their events
  • Connecting social media accounts (such as Facebook) to automatically detect and suggest events from posts
  • Notifications via the Platform and optional WhatsApp messaging

Nowt On acts solely as a listing directory and discovery platform. We are not an event organiser, ticketing agent, or venue operator, and we have no control over the events listed on the Platform.

2. Pilot Phase

The Platform is currently operating in a pilot / beta phase. During this period:

  • Features, integrations, and availability may change or be withdrawn without prior notice.
  • Access to the Platform is currently provided free of charge.
  • Nowt On reserves the right to introduce paid subscription tiers at any time. We will provide at least 30 days' advance notice via email before any charges apply.
  • If a paid subscription is introduced and you do not wish to subscribe, you may close your account. Your personal data will be deleted on request in accordance with our Privacy Policy.
  • No uptime service level agreement (SLA) applies during the pilot phase.

3. Eligibility

You must be at least 13 years of age to use the Platform. By creating an account, you represent and warrant that you meet this requirement. If you are creating a business account, you represent that you have the authority to bind that business to these Terms.

4. Accounts and Registration

  • You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
  • You agree to provide accurate and complete information when creating an account and to keep it up to date.
  • You must notify us promptly at info@nowton.events if you suspect any unauthorised use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

When using the Platform, you agree not to:

  • Post misleading, fraudulent, or spam event listings
  • Upload content that is unlawful, defamatory, obscene, or infringes the rights of others
  • Attempt to gain unauthorised access to the Platform, other accounts, or our systems
  • Use the Platform to scrape data, distribute malware, or conduct any automated activity without our written permission
  • Misuse any third-party integration (including Meta services) in a way that violates their terms of service
  • Impersonate another person, business, or organisation

We reserve the right to remove content and suspend or terminate accounts that breach these rules, without prior notice. We may also remove any content at our discretion where we consider it to be harmful, inaccurate, or inappropriate, even if it does not technically breach these Terms. Users may report problematic content to info@nowton.events.

6. Event Content

6.1. User-Submitted Content

When you submit event listings or other content to the Platform, you retain ownership of that content. However, by submitting it, you grant Nowt On a non-exclusive, royalty-free, worldwide licence to display, distribute, and promote your content within the Platform and related marketing channels.

6.2. Accuracy of Events and Organiser Responsibilities

Event organisers are solely responsible for their listings and all aspects of their events. This includes:

  • Accuracy: Ensuring listing details (date, time, venue, description, price, age restrictions) are accurate and kept up to date at all times, including notifying attendees of any changes or cancellations directly.
  • Changes and cancellations: Nowt On accepts no liability whatsoever for events that are cancelled, postponed, rescheduled, changed, or misrepresented — whether or not the Platform listing is updated to reflect those changes. It is the organiser's sole responsibility to keep their listing current and to communicate changes to attendees.
  • Health & safety: Complying with all applicable health and safety legislation and ensuring appropriate measures are in place at their event.
  • Licences and permits: Obtaining all necessary licences, permits, and consents required to hold and advertise their event (including entertainment licences, premises licences, or any other regulatory approvals).
  • Attendees: Any ticketing, refund, compensation, or consumer rights obligations owed to attendees are the sole responsibility of the event organiser. Nowt On is not a party to any transaction between organisers and attendees.
  • Legal compliance: Complying with all applicable laws in connection with the organisation and promotion of their event.

Nowt On does not guarantee the accuracy or completeness of any event listing and is not liable for reliance on any listing.

6.3. AI-Suggested Events

When you connect a social media account, the Platform may automatically detect potential events from your posts and present them to you as draft suggestions. These AI-generated drafts are never published without your explicit review and approval. You are responsible for verifying and editing any suggested event details before publishing.

7. Third-Party Integrations

7.1. Meta (Facebook and Instagram)

The Platform allows you to connect your Facebook Page to enable automatic event detection from your public posts. When you connect your account:

  • You explicitly authorise Nowt On to access the Facebook permissions you grant during the connection process
  • We only access the data necessary to provide the service (such as your Page's public posts and Page information)
  • Access tokens are encrypted and stored securely
  • You can disconnect your account and revoke access at any time from your account settings or directly through Facebook's app settings
  • Upon disconnection, your stored tokens are permanently deleted

Your use of Meta services is also subject to Meta's Terms of Service and Meta's Privacy Policy.

7.2. WhatsApp Notifications

If you opt in to WhatsApp notifications, you consent to receiving messages from Nowt On regarding event drafts and platform updates via WhatsApp. You can opt out at any time from your account settings. Standard messaging rates from your mobile provider may apply.

7.3. General

We are not responsible for the availability, accuracy, or conduct of any third-party service. Third-party integrations are provided on an "as available" basis and may be modified or discontinued at any time.

8. Intellectual Property

The Platform, including its design, branding, code, and original content, is owned by Nowt On and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Platform without our prior written consent.

Event content submitted by users remains the property of the respective creators, subject to the licence granted in section 6.1.

Any feedback, suggestions, or ideas you submit to us may be used by Nowt On without restriction or compensation to you.

9. Disclaimers and Limitation of Liability

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law:

  • We make no warranties, express or implied, regarding the Platform's reliability, availability, or fitness for a particular purpose.
  • We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.
  • We are not responsible for the actions, content, accuracy, conduct, or omissions of event organisers, attendees, or third-party services.
  • We are not liable for any loss or damage arising from reliance on any event listing, including where an event is cancelled, changed, or incorrectly described.
  • Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you have paid us (if any) in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

10. Termination

You may stop using the Platform and delete your account at any time. We may suspend or terminate your access if you breach these Terms, or if we discontinue the Platform.

Upon termination, your right to use the Platform ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.

11. Changes to These Terms

We may update these Terms from time to time. For material changes (including any introduction of fees, significant changes to your rights, or removal of features), we will provide at least 14 days' advance notice via email or a prominent in-platform notice before changes take effect. For minor or administrative changes, we will update the effective date at the top of this page and your continued use constitutes acceptance.

12. Dispute Resolution

Before commencing any formal legal proceedings, both parties agree to attempt to resolve any dispute informally. To do this, please contact us at info@nowton.events with a description of your concern. We will endeavour to respond within 14 days. This clause does not affect your statutory rights.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Platform that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. General

14.1. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severed from the remaining Terms, which shall continue in full force and effect.

14.2. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Nowt On regarding your use of the Platform and supersede any prior agreements or understandings.

14.3. Force Majeure

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to internet outages, third-party service failures (such as Meta, Supabase, or Vercel), natural disasters, or changes in law or regulation.

14.4. Waiver

Failure by Nowt On to enforce any provision of these Terms on any occasion shall not constitute a waiver of that provision or our right to enforce it on a future occasion.
